TERMS AND CONDITIONS OF USE

Welcome to Zenit. The terms "we", "us" and "our" refer to Zenit. By visiting, browsing or making a purchase in our store, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our services.

Our store is hosted on Shopify, a technology platform that allows us to offer you a secure and complete shopping experience.

SECTION 1 — ACCESS AND ACCOUNT

By using our services, you declare that you are of legal age under Spanish law (18 years) or that you have the consent of your legal guardian. You are responsible for maintaining the confidentiality of your login credentials and all activity carried out from your account. You may not transfer, sell or assign your account to third parties.

SECTION 2 — OUR PRODUCTS

We do our best to display our products as accurately as possible. However, colours and appearance may vary depending on the device you use. We do not guarantee that products will meet your visual expectations exactly. We reserve the right to modify descriptions, discontinue products or limit quantities at any time and without prior notice.

SECTION 3 — ORDERS

By placing an order you are making an offer to purchase. Zenit reserves the right to accept or reject any order at its sole discretion. The order will not be considered accepted until you receive confirmation by email. We recommend reviewing your order carefully before confirming the purchase, as once accepted it may not be possible to cancel it. Returns are governed by our Refund and Returns Policy.

SECTION 4 — PRICES AND BILLING

Prices are subject to change without notice. The applicable price will be the one in force at the time of placing the order, as indicated in the purchase confirmation. Unless expressly stated otherwise, prices do not include shipping costs or any additional applicable taxes. By making a purchase, you declare that the payment information provided is accurate, complete and that you are authorised to use it.

SECTION 5 — SHIPPING AND DELIVERY

Delivery timeframes are estimates and are not guaranteed. We are not responsible for delays caused by the carrier, customs procedures or circumstances beyond our control. Once the order is handed over to the carrier, the risk of loss or damage transfers to the buyer.

SECTION 6 — INTELLECTUAL PROPERTY

All content in this store, including texts, images, logos, videos, designs and trademarks, is the property of Zenit or its licensors and is protected by Spanish and international intellectual property law. Reproduction, distribution or commercial use without express written authorisation is prohibited. Shopify names and logos are the property of Shopify Inc.

SECTION 7 — THIRD-PARTY TOOLS

We may provide you with access to tools provided by third parties. These are offered "as is" and "as available", without warranties of any kind. Their use is at your own risk and discretion.

SECTION 8 — THIRD-PARTY LINKS

Our store may contain links to third-party websites. We are not responsible for their content, accuracy or privacy practices. We recommend reviewing their terms and policies before carrying out any transaction on those sites.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Zenit operates using Shopify technology. However, all sales are made directly between you and Zenit. Shopify is not a party to the commercial relationship and assumes no liability for transactions carried out in our store.

SECTION 10 — PRIVACY POLICY

The processing of your personal data is governed by our Privacy Policy, available in our store. By using our services, you confirm that you have read and accepted said policy.

SECTION 11 — REVIEWS AND COMMENTS

By submitting reviews, suggestions or any other content, you grant us a worldwide, royalty-free and sublicensable licence to use, reproduce and publish it in any medium for commercial or promotional purposes. You declare that you hold the rights to said content and that it does not infringe the rights of third parties. We reserve the right to remove content that is illegal, offensive or that breaches these Terms.

SECTION 12 — ERRORS AND INACCURACIES

We reserve the right to correct typographical errors, inaccuracies or omissions in prices, descriptions or product availability at any time and without prior notice, even after you have placed an order.

SECTION 13 — PROHIBITED USES

It is prohibited to use our services for illegal or fraudulent purposes or in ways that may cause harm to third parties, to Zenit or to Shopify. Among other things, you may not: transmit viruses or malicious code, carry out scraping or automated data extraction, impersonate other persons, send unsolicited communications or interfere with the security of the platform. Non-compliance may result in the suspension or cancellation of your account without prior notice.

SECTION 14 — AUTOMATED AGENTS

No software or automated agent may access, use or interact with our services without expressly identifying itself as such in each request. Such agents are prohibited from imitating human behaviour, circumventing CAPTCHA systems or bypassing security measures. We reserve the right to technically block access by any agent that does not comply with these conditions.

SECTION 15 — TERMINATION

We may suspend or cancel your access to our services at any time and without prior notice if you breach these Terms. The sections relating to intellectual property, limitation of liability, indemnification and applicable law will remain in force after any termination.

SECTION 16 — DISCLAIMER OF WARRANTIES

Services and products are offered "as is" and "as available". To the extent permitted by Spanish and European law, we exclude any implied warranties of merchantability, fitness for a particular purpose or freedom from errors. This exclusion does not affect the rights granted to you as a consumer under Spanish consumer protection legislation.

SECTION 17 — LIMITATION OF LIABILITY

To the maximum extent permitted by law, Zenit shall not be liable for indirect, incidental, special or consequential damages arising from the use of our services. This limitation does not affect the non-waivable rights to which you are entitled as a consumer under Spanish and European law.

SECTION 18 — INDEMNIFICATION

You agree to indemnify Zenit and Shopify against any claims, damages or expenses — including legal fees — arising from your breach of these Terms, your violation of third-party rights or your misuse of the services.

SECTION 19 — SEVERABILITY

If any provision of these Terms is declared null or unenforceable, the remaining provisions will remain fully in force.

SECTION 20 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and other policies published in the store, constitute the entire agreement between you and Zenit regarding the use of our services.

SECTION 21 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Zenit may assign these Terms without prior notice.

SECTION 22 — APPLICABLE LAW AND JURISDICTION

These Terms are governed by Spanish law. For the resolution of any dispute, both parties submit to the courts and tribunals of Barcelona, without prejudice to the rights granted to you as a consumer under European consumer protection regulations.

SECTION 23 — CHANGES TO THESE TERMS

We reserve the right to update these Terms at any time. We will notify you of relevant changes and the date they come into effect. Continued use of our services after the publication of changes implies acceptance of them.
